Maqasih Syariah sebagai Landasan Reformasi Hukum Perceraian dan Hak Asuh Anak dalam Konteks Modern

Penelitian ini bertujuan untuk menganalisis peran maqasid al-syari’ah sebagai landasan filosofis dan metodologis dalam reformasi hukum perceraian dan hak asuh anak. Penelitian ini menggunakan pendekatan kualitatif dengan metode penelitian hukum normatif-filosofis melalui studi kepustakaan terhadap sumber hukum primer, sekunder, dan tersier, yang dianalisis menggunakan teknik analisis isi secara deduktif dan induktif. Hasil penelitian menunjukkan bahwa maqasid al-syari’ah, khususnya prinsip hifẓ al-dīn, hifẓ al-nafs, hifẓ al-nasl, dan hifẓ al-‘aql, berperan penting dalam mendorong pergeseran paradigma hukum keluarga Islam dari legalisme tekstual menuju keadilan substantif. Pendekatan maqasid terbukti mampu mengakomodasi perlindungan hak perempuan dan anak serta menjembatani antara norma syariah dan realitas sosial modern. Dengan demikian, pendekatan maqasid al-syari’ah menjadi instrumen strategis dalam mewujudkan reformasi hukum keluarga Islam yang adaptif, berkeadilan, dan relevan dengan tantangan masyarakat modern. Implikasi penelitian ini menegaskan bahwa maqasid al-syari’ah dapat dijadikan dasar normatif dan metodologis bagi pembaruan regulasi serta praktik peradilan agama yang lebih humanis, berkeadilan gender, dan berorientasi pada kemaslahatan anak dalam konteks hukum keluarga Islam kontemporer.
